WAIVER AND RELEASE AGREEMENT

NOTICE TO ALL PARTICIPANTS IN ACTIVITIES ORGANIZED BY THE TPAAA.

BY FILLING OUT AND SUBMITTING THIS FORM YOU WILL LOSE YOUR RIGHT TO SUE AND THE ABILITY TO CLAIM DAMAGES OR SEEK COMPENSATION FROM THE TPAAA. THE CONDITIONS CONTAINED HEREIN WILL AFFECT YOUR LEGAL RIGHTS. READ THE DOCUMENT VERY CAREFULLY. YOU MAY WISH TO CONSULT WITH YOUR LEGAL ADVISOR.

THE 52 DIVISION BILL HARPER MEMORIAL RUN

In consideration of my acceptance as a participant in TPAAA sponsored activities and games (the "Activities"):

1.    I hereby waive and release for myself and my heirs, executors, and the aministrators any claims of any nature whatsoever which I might at any time have against the TPAAA, it's employees and agents and all other organizers, sponsors, representatives and their respective agents and employees and any other person or organization involved in thise event including but not limited to affiliate associations of the TPAAA, local owners and operators of the premises used to conduct any event, member teams, local associations, event hosts, other participants, coaches, officials and advertisers and their respective directors, agents and employees (all of such parties collectively referred to as the "Releasees") from any claims for damagees or injuriessuffered by me as a result of my perticipation in or travelling to or from this event. I acknowledge that I will use the services provided at my own risk. I confirm that I have given accurate answers to the above questions and that I will carefully follow all directions given including all rules relating to participation in the Activities.

2.    I acknowledge, understand and assume all risks inherent in the Activities and any member team activities, and understand that said sport and activiies involve risks to the participant's person including bodily injury, partial or total disability, paralysis, and death, and damages (including but not limited to severe social and economic losses) which may arise therefrom and that I have full knowldege of said risks. These risks and dangers may be caused not only by my actions, inactions or negligence but by the actions, incations or negligence of others, including the Releasees, the rules of play or the conditions of the premises or of any of the equipment used. It is further acknowledged that there may be risks and dangers not known to the Releasees or myself or are not reasonably foreseeable at this time. I accpet personal responsibility for all of such damages following any such injury, permanent diability or death. I knowingly and freely assume all risjs associated with my participation in the Activities, and assume full responsibility for my participation.

3.    I acknowledge, understand and assume the risks, if any, arising from the conditions and use of facilites and related premises where the Activities are carried out and acknowledge and understand that included within the scope of this waiver and release is any cause of action, arising from the performance, or failure to perform maintenance, inspection supervision or control of said areas and for the failure to warn of dangerous conditi ons existing at said facilities or premises, for negligent selection of certain Releasees, or negligent supervision or instruction by Releasees.

4.    I confirm that I am physically capable and fit to participate in the Activities and I have no special medical condidions or needs.

5.    I further agree that under no circumstances will I prosecute or present any claim against the Releasees for any cause of action, for personal injury, property damage, or wrongful death, whether the same shall arise by the negligence or non-intentional conduct of any of said Releasees from the Activities or any pursuit incedental thereto.

6.    This Agreement is intended to be as broad as is permissible under the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario and this Agreement shall be interpreted under the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

7.    If any portion of this Agreement is invalid and/or is declared to be invalid by a COurt of competent jurisdiction, it is agreed that the balance of the Agreement shall continue in full force and effect unamended.

8.    I have read and voluntarily sign this waiver and release Agreement and further agree that no oral representations, statements, or inducements apart from this written Agreement have been made to me by any person including but not limited to the Releasees. I am fully advised as to the potential dangers of the Activities and understand that these waivers and releases are necessary to allow amateur sporting activities such as the Activities to exist in their present form.

9.    I hereby acknowledge and grant TPAAA, its employees, contractors, and subcontractors of such contractors, (i) the right to photograph me and use my picture and any other reproduction of my physical likeness (as the same may appear in any still camera photograph and motion picture) in, and in connection with , exhibition, theatrically, on television or otherwise, or any mtion pictures(s) in which the same may be used or incorporated, and also in the advertising, exploiting, and/or publicizing of any such motion pictures(s), but not limited to television or theatrical motion picture(s); and (ii) inclusion of my name and picture or likeness in any written account of the Activities, and in this regard I hereby certify and represent that I have received valuable consideration in return for said release, and hereby waive any and all rights to compensation in connection with the utilization of my name, picture and any other reproduction of my physical likeness with reference to the Activities.

10.    I will comply with the stated and customary terms, conditions and rules for participation in the Activities. If, however, I observe any unusual significant hazard during my presence of participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

11.    I agree that if, despite the release and waiver of liability provisions contained in this Agreement and my assumption of all risks, I, or anyoneon my behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any litigation, mediation, arbitration or hearing expenses, legal fees, losses liability, damage, or costs which any of the Releasees may incur as a result of such a claim.
